New Bullying & Harassment Regime

A new Anti-bullying jurisdiction has come into effect from 1 January 2014 which allows for the Fair Work Commission to deal with workplace bullying. The recent amendment allows for workers who feel they have been bullied at work to make an application to the Fair Work Commission. Bullying under the legislation is defined as individuals or groups of individuals repeatedly behaving unreasonably towards the worker or a group of workers, creating a risk to health and safety. Case Study: Redundancy turns into Unfair Dismissal

Recently, HR for SmallBiz was instrumental in settling a claim of Unfair Dismissal lodged at the Fair Work Commission against its client, the employer. The matter involved an ex-employee who was made redundant for reasons of a downturn in sales, which required a restructure of the sales team.
